Two Cornelius men are accused of defrauding investors out of nearly $6 million.

The Security and Exchange Commission filed a complaint against Dana Bradley and Marlin Hershey, and several companies they own, with the U.S. District Court in Charlotte on Sept. 30.

According to the SEC, the men told investors they were raising the money to develop and restore homes in the Charlotte area. But the partners allegedly used the funds to repay other investors.

According to the complaint, Bradley and Hershey weren’t registered as a brokers with the SEC during the time they were offering securities. Most brokers are required by U.S. law to register with the SEC.

The eight companies named in the civil action complaint are: Performance Retire on Rentals, Distressed Lending Fund, Bryant Boys, D. Bradley Inc., Erndit LLC, Hershey Enterprises, MW Enterprises and Performance Holdings.
